When some genius at ATF decided to rule that pistol-grip shotguns were not shotguns, that uncorked a bunch of stuff. First thing: If a firearm has a bore diameter of more than .50", it is a destructive device unless it is a sporting shotgun; some large-bore rifles are exempt however. By ruling that the pistol-grip shotgun is NOT a shotgun, ATF set up a conflict with the NFA and the Destructive Device part of the statute. It is also true ATF has never exactly enforced the DD provision--look at the short-barrel shotgun AOWs! Neither ATF nor the NRA wanted to go there. Meanwhile, back at the ranch, Mossberg and others have been marketing pistol-grip firearms (shotguns, 12 gauge variety) that have 14" barrels with 26" in overall length, as Title I firearms. In my view, given the fact there are probably millions of pistol-grip shotguns that were manufactured for decades before ATF made its ruling, turning all those folks into possessors of illegal contraband that cannot be registered except during an amnesty period (which ATF does not want to do), would not go down well politically, and it would make ATF look pretty foolish. Get that issue into a Federal District Court, I doubt that any federal judge would do anything but rule that the millions of pistol-grip shotguns were Destructive Devices. Talk about disruption.
